What is a Defective Product?

A defective product is a product that does not possess the characteristics agreed upon by the parties or objectively required at the time of delivery, does not conform to features stated on its packaging, label, or user manual, or is contrary to specifications set in technical regulations.

Consumer's Alternative Rights

A consumer who receives a defective product may exercise one of the following alternative rights:

Free repair: Request free repair of the product
Replacement: Request replacement with a non-defective product
Price reduction: Request a proportional reduction from the purchase price
Withdrawal from contract: Request refund of the amount paid

Right of Withdrawal

In distance sales (internet, phone, etc.), the consumer may withdraw from the contract within 14 days of receiving the product without providing any reason. Upon withdrawal, the payment is refunded within 14 days.

Warranty Periods

The minimum warranty period for consumer goods is 2 years. The seller, manufacturer, and importer are jointly liable for defects that appear during this period. For second-hand goods, the warranty period may be set at a minimum of 1 year.

Complaint Application Channels

Channels available for consumer rights violations:

Consumer Arbitration Board: For disputes below a certain amount (104,000 TL for 2024)
Consumer Court: For objections to arbitration decisions and disputes above the upper limit
ALO 175 Consumer Line: For complaints and information
e-Government Consumer Complaint System: For online applications

Unfair Commercial Practices

Commercial practices that are deceptive, misleading, or aggressive in nature are considered unfair commercial practices. Consumers can exercise their legal rights against these practices and claim compensation.

Consumer rights constitute one of the most important areas of protection in the modern legal system. It is crucial for consumers to know their alternative rights when dealing with defective goods and services and to apply in a timely manner.
