What is a Reinstatement Lawsuit?

A reinstatement lawsuit is filed by a worker covered by job security protection who requests reinstatement after being dismissed for unjust or invalid reasons. Article 20 of the Labor Law No. 4857 regulates this matter.

Conditions for Filing a Reinstatement Lawsuit

The following conditions must all be present to file a reinstatement lawsuit:

• At least 30 workers must be employed at the workplace
• The worker must have at least 6 months of seniority
• The employment contract must be indefinite-term
• The worker must not hold an employer representative position
• The termination must not be based on a valid reason

Mandatory Mediation

Mediation is mandatory before filing a reinstatement lawsuit. The worker must apply to a mediator within 1 month of receiving the termination notice. If no agreement is reached in mediation, the lawsuit must be filed within 2 weeks of the final report.

Valid Reasons for Termination

Reasons that may validate the employer's termination are divided into two categories:

Worker incompetence:

• Poor performance
• Frequent medical reports
• Inability to adapt to work

Operational requirements:

• Economic difficulties
• Technological changes
• Downsizing or closure of the workplace

Consequences of Reinstatement Decision

If the court orders reinstatement:

• The worker is paid up to 4 months of idle period wages
• The worker must apply to return to work within 10 business days of the decision becoming final
• The employer must reinstate the worker within 1 month
• If not reinstated, 4-8 months' wages must be paid as non-reinstatement indemnity

Idle Period Compensation

Idle period compensation covers wages from the termination date to the finalization of the court decision. This period is limited to a maximum of 4 months. Wages and other rights for this period are calculated and paid to the worker.

Non-Reinstatement Indemnity

If the employer fails to reinstate the worker despite the court order, they must pay indemnity of at least 4 and up to 8 months' wages. This indemnity is independent of severance pay and other labor claims.

Conclusion

Reinstatement lawsuits are an important legal mechanism ensuring worker protection under job security provisions. Not missing the mediation application and lawsuit filing deadlines is vitally important. Professional legal support in labor law is crucial for proper process management and rights protection.
